Trail passes shall remain the property of the Kawartha ATV Association (KATVA). The registered holder shall surrender the pass to KATVA
upon written request. KATVA may suspend or revoke membership or trail passes when in their opinion the individual holding the
membership or pass fails to comply with the condition of sale or the bylaws of KATVA or the Laws of the province of Ontario. Any
suspension or surrender of membership or pass may be subject to such Terms as the KATVA prescribes.
It is understood that the landowners on or adjacent to the trail system of KATVA, it’s reciprocating organizations, it's members, directors,
officers, employees, and their respective agents, officials, servants and representatives are collectively known as the "host". In addition to
consideration given to the "host" for any driver or passenger operating the aforementioned permitted use I and my heirs, next of kin,
executers, administrators (collectively my legal representatives) agree:
To waive all claims that I may have or in the future against the "host"
To release and forever discharge the "host" from all liability for any personal injury, property damage, or loss resulting from my
permitted pass use do to any cause, including but not limited to negligence, breach of any duty imposed by law, breach of contract,
or mistake or error in judgment of the "host" and
To be liable for and hold harmless and indemnify the "host" from all actions, proceedings, claims,
damages, costs, demands, including court costs and costs on a solicitor and own client basis, and liabilities of whatsoever nature or
kind arising out of or in any way connected with my permitted trail use.
It is understood the all trail pass holders are a minimum of sixteen years of age and maintain a valid G2 / G or M2 / M Ontario drivers
license and must have their ATV plated and insured and wear an approved helmet at all times when riding the trails. Children between 12
and 16 must be supervised by an adult when on the trails, at all times.
Obey all signs and abide by the Highway Traffic Act, Off-road Vehicle Act, Trespass Property Act and County and Municipal bylaws.
Stop when requested to by trail wardens or bylaw officers or police officers. By checking the box below the trail pass holder warrants that
they accept the Conditions of Sale.
